Justice Sathyanarayanan to hear MLAs disqualification case

The Supreme Court has refused to transfer the case of disqualification against AIADMK MLAs supporting T T V Dinakaran. A petition was filed by disqualified MLAs supporting Dinakaran seeking to transfer the case from the Madras High Court to the Supreme Court. However, the court said the case could be transferred to a new judge, Justice M Sathyanarayana, replacing Justice S Vimala.
The case was to be heard by Justice S Vimala. The Madras High Court on June 18 appointed Justice S Vimala to hear the pleas against the disqualification of the AIADMK rebel MLAs after two judges gave a split verdict on June 14. Chief Justice Indira Banerjee had upheld the disqualification, while Justice M Sundar quashed the disqualification.
In September 2017, Tamil Nadu Assembly Speaker P Dhanapal disqualified 18 MLAs of the AIADMK after they supported rebel leader TTV Dinakaran. Their disqualification brought the Assembly's effective strength down to 216 and the half-way mark to 108.
Justice M. Sathyanarayanan was appointed as an Additional Judge of the Madras High Court on April 23,2008 and as permanent Judge on November 9, 2009.
The Supreme Court judges today said it was not proper on the part of the petitioners to make charges against a judge, Justice Vimala, and suggested that the remarks against her be withdrawn by the petitioners. However, the SC judges recommended that Justice Vimala be replaced by Justice Sathyanarayanan. The petitioners later withdrew the charges against Justice Vimala.
Following a split verdict in the Madras High Court in the disqualification case on June 14, Indira Banerjee said the case will go to a third judge. Since she had heard the case, she would leave it to the seniormost judge after her to nominate the third judge to hear the case, Indira Banerjee said.
