There is no prospect for an immediate bail application for Tamil Nadu chief minister J Jayalalithaa, and she will have to commence her jail term immediately, Special Prosecutor Bhavani Singh said soon after the special court verdict against her in the DA case on September 27, 2014.
Bhavani Singh said there is no possibility of granting bail immediately as the jail term was for more than three years - in this case, four years. Of course, bail application can be moved before the High Court in Bengaluru, but the process could take a few days at least. For instance, it may take at least two or three days to get an order of the court.
Prosecution sources also said moving a bail application in such a case was also difficult as the process was cumbersome.
The special court had sentenced Jayalalithaa to four years simple imprisonment and a fine of Rs 100 crore, Bhavani Singh said, in reply to a question.
He said the court had also sentenced Jayalithaa's close aide Sasikala Natarajan, her relatives Ilavarasi and V N Sudhagaran (former adopted son of Jayalalithaa to a jail term of four years each as also a fine of Rs 10 crore each.
Replying to a question, the prosecutor said Jayalalithaa had been referred for medical examination as instructed by the court. On completion of the examination, she was being taken to Bengaluru central prison to be lodged there for the jail term.
He said the prosecution had proved its case and law had taken its own course. "I am satisfied", he said with regard to the completion of the case.
On whether Jayalalithaa would get special facilities or a special jail, the prosecutor said this had already been considered by the court and it had ordered that she be taken to the central jail after medical examination. Therefore, there would be no special facilities.
The fine of Rs 100 crore would be adjusted against the assets seized and deposited with the court.
Bail application cannot be done now as the jail term is for four years, the prosecutor said.
On whether the CM would be moved to Tamil Nadu prison, the prosecutor said it was not possible as the case had been conducted by special court in Karnataka and she would be lodged only in Karnataka.
